Consumer Health Data Privacy Policy- Vitatyme


Effective Date: January 1, 2026

This Consumer Health Data Privacy Policy describes how Vitatyme Nutraceuticals LLC, doing business as “Vitatyme” (“Vitatyme,” “we,” “us,” or “our”), collects, uses, discloses, and protects consumer health data.

This policy supplements our general Privacy Policy and applies to consumer health data subject to applicable consumer health privacy laws, including Nevada’s consumer health privacy law and the Washington My Health My Data Act.

Vitatyme is a beauty and wellness company—not a healthcare provider. Vitatyme does not provide medical diagnosis, treatment, or emergency medical services.

This policy applies to consumer health data collected through www.shopvitatyme.com, wellness quizzes, product-matching tools, health or safety forms, event registrations, customer-service communications, product reviews, adverse-event reports, and other Vitatyme services that link to this policy.

1. WHAT IS CONSUMER HEALTH DATA?

Consumer health data generally means personal information that is linked or reasonably linkable to an individual and identifies or reveals information concerning that individual’s past, present, or future physical or mental health.

Consumer health data may include information provided directly by a consumer as well as information that may be inferred from purchases, quiz responses, communications, or interactions with Vitatyme.

Consumer health data does not include information excluded from applicable consumer health privacy laws, including information treated as deidentified under applicable law or information otherwise subject to a statutory exemption.

2. CONSUMER HEALTH DATA WE MAY COLLECT

Depending on how you interact with Vitatyme and what information you voluntarily provide, we may collect the following categories of consumer health data:

a. Wellness Goals and Interests

This may include beauty, skin, hair, digestive, hormonal, menstrual, nutritional, sleep, energy, stress, mood, weight-management, fitness, or general wellness goals.

b. Physical and Mental Health Information

This may include information concerning physical or mental conditions, symptoms, health concerns, prior experiences, emotional wellness, stress, sleep, mood, or information you voluntarily provide when seeking product information or customer support.

c. Reproductive and Hormonal Information

This may include information concerning menstrual cycles, premenstrual symptoms, hormonal wellness, pregnancy, nursing, attempts to become pregnant, menopause, or other reproductive or hormonal considerations.

d. Allergies, Sensitivities, and Dietary Information

This may include food allergies, ingredient allergies, sensitivities, dietary restrictions, dietary preferences, and information concerning ingredients or products you prefer to avoid.

e. Medication and Supplement Information

This may include information about medications, supplements, vitamins, herbs, or other products you currently use or previously used.

f. Product-Use and Safety Information

This may include:

  • Products used or purchased;
  • Frequency or duration of use;
  • Reported results or experiences;
  • Side effects, sensitivities, reactions, or adverse events;
  • Relevant photographs, videos, medical information, or supporting documents voluntarily submitted;
  • Lot numbers, expiration dates, and product-label information; and
  • Communications relating to a product complaint, replacement, recall, or safety investigation.

g. Wellness Quiz and Product-Matching Information

This may include responses submitted through wellness quizzes, product finders, questionnaires, surveys, intake forms, or similar tools.

We may use these responses to suggest products or educational content that may be relevant to the interests you identify. Such suggestions are not medical diagnoses, prescriptions, or guarantees that a product is safe or appropriate for you.

h. Event and Accommodation Information

If you register for a Vitatyme event, class, sound bath, wellness experience, dinner, or other gathering, we may collect information you voluntarily provide concerning:

  • Accessibility or accommodation needs;
  • Dietary restrictions or allergies;
  • Physical limitations;
  • Emergency considerations;
  • Emotional or wellness concerns relevant to participation; and
  • Information contained in an event acknowledgment, waiver, or safety form.

i. Health-Related Inferences

We may derive limited inferences from information you voluntarily provide, such as identifying a general product category that may align with your stated wellness interests.

We do not use consumer health data to diagnose a medical condition or make decisions concerning employment, insurance, credit, housing, education, or eligibility for medical treatment.

3. SOURCES OF CONSUMER HEALTH DATA

We may collect consumer health data from:

  • You directly;
  • A parent, guardian, authorized representative, or other person acting with your authorization;
  • Wellness quizzes, questionnaires, forms, surveys, and product-matching tools;
  • Customer-service emails, chats, telephone calls, text messages, or other communications;
  • Product reviews, testimonials, photographs, videos, and other content you voluntarily submit;
  • Event registrations, releases, waivers, and accommodation requests;
  • Order and subscription history when it reveals or may permit an inference concerning a wellness interest;
  • Product-safety complaints and adverse-event reports;
  • Technology providers that operate forms, quizzes, communications, or customer-support systems on our behalf; and
  • Other sources you authorize or that applicable law permits.

Vitatyme does not purchase consumer health data from data brokers.

4. WHY WE COLLECT AND USE CONSUMER HEALTH DATA

We may collect and use consumer health data for the following purposes:

  • To provide a wellness quiz, questionnaire, or product-matching tool requested by you;
  • To identify Vitatyme products or educational content that may correspond with wellness interests you voluntarily select;
  • To respond to product questions and customer-service requests;
  • To identify allergies, sensitivities, or other concerns reported by a customer;
  • To investigate product complaints, reactions, side effects, or adverse events;
  • To satisfy FDA reporting, recordkeeping, product-safety, recall, or other regulatory obligations;
  • To communicate with consumers concerning reported safety matters;
  • To administer event registrations, waivers, accommodations, and safety procedures;
  • To improve product instructions, customer support, and product-safety practices;
  • To maintain records of consent, authorization, withdrawal, or privacy requests;
  • To prevent fraud, misuse, unlawful activity, and security incidents;
  • To comply with law, legal process, insurance requirements, or regulatory requests;
  • To establish, exercise, or defend legal claims; and
  • For another disclosed purpose with your legally valid consent.

Vitatyme will not collect, use, or share additional categories of consumer health data—or use existing consumer health data for a materially different purpose—without providing any additional notice and obtaining affirmative consent when required by law.

5. CONSUMER HEALTH DATA WE MAY SHARE

Depending on the service requested and the information provided, the categories of consumer health data we may share include:

  • Contact and identification information;
  • Wellness quiz or questionnaire responses;
  • Stated wellness interests and product preferences;
  • Allergy, sensitivity, dietary, accommodation, or accessibility information;
  • Product-purchase and product-use information;
  • Product-complaint and adverse-event information;
  • Event-registration and safety information;
  • Relevant photographs, videos, documents, or communications voluntarily submitted; and
  • Records necessary to document consent, comply with law, or administer a privacy request.

We limit sharing to information reasonably necessary for the applicable purpose.

6. CATEGORIES OF RECIPIENTS

We may share consumer health data with the following categories of recipients:

a. Website, Hosting, and Technology Providers

This may include Shopify and providers that host, maintain, secure, or support Vitatyme’s Website, forms, databases, and business systems.

b. Quiz, Form, and Customer-Support Providers

This may include technology companies that operate wellness quizzes, questionnaires, intake forms, surveys, email systems, chat systems, or customer-support tools on our behalf.

c. Product-Safety and Fulfillment Partners

When reasonably necessary to investigate a complaint or safety issue, we may share relevant information with a product manufacturer, formulator, fulfillment provider, laboratory, quality-control provider, shipping provider, or other party involved with the affected product.

d. Event Providers

We may share necessary accommodation, allergy, accessibility, emergency, or participation information with event venues, instructors, caterers, registration providers, safety personnel, or other event-service providers.

e. Professional Advisers

This may include attorneys, accountants, auditors, insurers, medical or scientific consultants, and other professional advisers assisting Vitatyme with compliance, safety, or legal matters.

f. Government and Regulatory Authorities

We may disclose information to the U.S. Food and Drug Administration, courts, law-enforcement agencies, public-health authorities, or other regulators when required or permitted by law.

g. Service Providers Processing a Privacy Request

We may share information necessary to authenticate, process, document, or fulfill a consumer health data request.

h. Persons You Authorize

We may share consumer health data with another person or organization when you direct us to do so or provide legally valid consent.

Vitatyme does not share consumer health data with advertising networks or social-media advertising platforms for targeted advertising.

Vitatyme does not permit a processor to collect, use, or disclose consumer health data in a manner inconsistent with this policy or our instructions.

7. NO SALE OF CONSUMER HEALTH DATA

Vitatyme does not sell consumer health data.

Vitatyme will not sell consumer health data in exchange for money or other valuable consideration unless it first obtains the separate, legally required written authorization from the affected consumer.

Providing ordinary consent to this policy, completing a quiz, purchasing a product, creating an account, or agreeing to receive marketing communications does not constitute authorization to sell consumer health data.

8. NO HEALTH-BASED TARGETED ADVERTISING

Vitatyme does not use consumer health data from wellness quizzes, health questionnaires, adverse-event reports, event accommodation forms, or private customer-service communications for targeted advertising.

Vitatyme may use general Website activity for analytics or advertising as described in our general Privacy Policy and Cookies Policy. However, we do not intentionally provide private quiz responses, medical information, reported symptoms, adverse-event information, or accommodation information to advertising platforms for targeted advertising.

9. CONSUMER CONSENT

Where applicable law requires consent, Vitatyme will obtain affirmative consent before collecting or sharing consumer health data.

A consumer’s consent to collect consumer health data does not automatically constitute consent to share that data.

Where separate consent is required for sharing, Vitatyme will request that consent separately and identify the categories of information involved, the purpose of the sharing, and the intended recipients.

You may withdraw consent as described below. Withdrawal will not affect processing that occurred lawfully before the withdrawal.

10. YOUR CONSUMER HEALTH DATA RIGHTS

Depending on applicable law, you may have the right to:

  • Confirm whether Vitatyme is collecting, sharing, or selling consumer health data concerning you;
  • Access consumer health data concerning you;
  • Obtain a list of the third parties or affiliates with whom your consumer health data has been shared or sold, including available contact information;
  • Withdraw consent to the collection of consumer health data;
  • Withdraw consent to the sharing of consumer health data;
  • Request deletion of consumer health data;
  • Appeal Vitatyme’s refusal to act on a request; and
  • Exercise these rights without unlawful discrimination, retaliation, or denial of service.

A deletion request may require Vitatyme to notify applicable processors, contractors, affiliates, or other recipients so that they can delete the relevant consumer health data as required by law.

Deletion from archived or backup systems may be delayed for the period permitted by applicable law.

Certain information may be retained when permitted or required by law, including information reasonably necessary to:

  • Complete a transaction requested by you;
  • Protect security or prevent fraud;
  • Establish, exercise, or defend legal claims;
  • Comply with product-safety, adverse-event, tax, accounting, or regulatory obligations;
  • Protect another person’s rights or safety; or
  • Fulfill another legal exception.

11. HOW TO EXERCISE YOUR RIGHTS

Please state:

  • Your name;
  • The email address associated with your interaction with Vitatyme;
  • Your state of residence;
  • The right you wish to exercise; and
  • Sufficient information for us to identify the relevant records.

You are not required to create a new Vitatyme account to submit a request.

We may request additional information reasonably necessary to authenticate your identity and protect consumer health data from unauthorized access or deletion. Information provided for verification will be used only to process and document the request.

We will respond without undue delay and within the period required by applicable law. Where permitted, we may extend the response period if reasonably necessary and will notify you of the extension and the reason for it.

12. APPEALS

If Vitatyme declines to act on a consumer health data request, you may appeal the decision by emailing:

Please identify the original request and explain why you believe the decision should be reconsidered.

Vitatyme will review and respond to an appeal within the period required by applicable law. If an appeal is denied, we will provide information concerning any available method for submitting a complaint to the appropriate attorney general or regulatory authority.

13. DATA RETENTION

Vitatyme retains consumer health data only for as long as reasonably necessary to fulfill the purposes described in this policy or satisfy legal, regulatory, safety, insurance, accounting, or dispute-resolution requirements.

Retention periods depend on the type of information and the reason it was collected.

Dietary-supplement adverse-event reports and related records may be retained for at least six years or for a longer period when required by law.

Wellness quiz responses and product-matching information may be deleted or deidentified when no longer reasonably necessary for the requested service, subject to applicable legal and technical requirements.

Consent, withdrawal, and privacy-request records may be retained as necessary to document compliance.

14. DATA SECURITY

Vitatyme uses reasonable administrative, technical, and physical safeguards designed to protect consumer health data against accidental loss, unauthorized access, misuse, alteration, and disclosure.

Access to consumer health data is limited to persons and providers that reasonably require access for an authorized purpose.

No electronic transmission, Website, database, or storage system can be guaranteed completely secure. If you believe consumer health data provided to Vitatyme has been compromised, contact us promptly.

15. GEOFENCING

Vitatyme does not use geofencing around healthcare facilities to identify, track, collect data from, or send health-related messages or advertisements to consumers based on their presence near a healthcare facility.

16. CHILDREN’S CONSUMER HEALTH DATA

Vitatyme’s Services are not intended for individuals under 18, and Vitatyme does not knowingly collect consumer health data directly from children under 18.

If you believe a minor has submitted consumer health data to Vitatyme, contact us so that we can investigate and take appropriate action.

17. CHANGES TO THIS POLICY

Vitatyme may update this Consumer Health Data Privacy Policy to reflect changes in law, technology, business practices, or the ways we collect and use consumer health data.

The revised policy will be posted with an updated effective date.

When required by law, Vitatyme will provide additional notice and obtain affirmative consent before collecting, using, or sharing additional categories of consumer health data or using existing consumer health data for a materially different purpose.
